On behalf of the Offices with the Office of Solid Waste and Emergency Response (the Office of Superfund Remediation and Technology Innovation, the Office of Brownfields and Land Revitalization, the Office of Underground Storage Tanks, the Office of Emergency Management, the Office of Resource Conservation and Recovery, and the Federal Facilities Restoration and Reuse Office) and the Office of Site Remediation Enforcement, I am transmitting a draft guidance, titled Institutional Controls: A Guide to Preparing Institutional Control Implementation and Assurance Plans at Contaminated Sites (ICIAP guidance). This guidance is attached for your review and comment.
The ICIAP guidance is intended to assist site project managers and attorneys on how to develop ICIAPs at sites handled under the Agency’s various cleanup programs (Superfund remedial and removal, Federal Facilities, Brownfields, Underground Storage Tanks and Resource Conservation and Recovery Act sites). An ICIAP is document designed to systematically (a) establish and document the activities necessary to implement and ensure the long-term stewardship of ICs, and (b) specify the persons and/or organizations that will be responsible for conducting these activities.
If issues involving the use of institutional controls at a specific site arise that may be of tribal interest, EPA will offer formal consultation, consistent with the May 4, 2011 "EPA Policy on Consultation and Coordination with Indian Tribes".
