Purpose: In this order, EPA denies an objection to a prior order denying a petition requesting that EPA revoke all pesticide tolerances for dichlorvos under section 408(d) of the Federal Food, Drug, and Cosmetic Act. The objection was filed on February 1, 2008, by the Natural Resources Defense Council (NRDC). The original petition was also filed by NRDC. Previously, in July 2008, EPA denied this same objection but the United States Court of Appeals for the Second Circuit vacated that decision, in part, and remanded the matter to EPA. This order is being issued in response to the court's remand.

2. Notice of Receipt of Requests for Amendments To Delete Uses in Certain Pesticide Registrations

Purpose: In accordance with section 6(f)(1) of the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), as amended, EPA is issuing a notice of receipt of request for amendments by registrants to delete uses in certain pesticide registrations. Section 6(f)(1) of FIFRA provides that a registrant of a pesticide product may at any time request that any of its pesticide registrations be amended to delete one or more uses. FIFRA further provides that, before acting on the request, EPA must publish a notice of receipt of any request in the Federal Register.

Purposes: EPA issued notices in the Federal Register of November 23, 2011 and February 15, 2012, concerning the voluntary cancellation of several pesticide products, including Amrep, Inc.'s MGK-264/Pyrethrins/Pyriproxyfen/Permethrin product EPA Reg. No. 010807-00448. This document corrects typographical errors in the November 23, 2011 notice and February 15, 2012 cancellation order regarding the EPA registration numbers of the Amrep, Inc., MGK 264/Pyrethrins/Pyriproxyfen/Permethrin product affected by the cancellation order.

8. Exemption from the Requirement of a Tolerance: Nitric Acid

Purposes: This regulation establishes an exemption from the requirement of a tolerance for residues of nitric acid (CAS Reg. No. 7697-37-2) when used as an inert ingredient in antimicrobial pesticide formulations applied to food-contact surfaces in public eating places, dairy processing equipment, and food-processing equipment and utensils at a maximum level in the end-use concentration of 1,000 parts per million (ppm). Ecolab Inc. submitted a petition to EPA under the Federal Food, Drug, and Cosmetic Act (FFDCA), requesting establishment of an exemption from the requirement of a tolerance. This regulation eliminates the need to establish a maximum permissible level for residues of nitric acid.
