Tribal Webcast on permitting requirements for pesticide discharges to waters of the United States on April 18
The U.S. Environmental Protection Agency (EPA) is hosting a webcast on April 18, 2012 for tribal audiences to discuss the implications of a recent court decision on Clean Water Act (CWA) permitting requirements for pesticide discharges to waters of the United States. The EPA is the agency responsible for issuing these permits for discharges on all Indian Country lands in the U.S. except for those lands located within the State of Maine.
On October 31, 2011, EPA issued a final CWA National Pollutant Discharge Elimination System (NPDES) Pesticide General Permit (PGP) for point source discharges from the application of pesticides to waters of the United States. This action was in response to a 2009 decision by the U.S. Sixth Circuit Court of Appeals that found point source discharges of biological pesticides, and chemical pesticides that leave a residue, into waters of the U.S. require an NPDES permit under the Clean Water Act. The court’s decision took effect (i.e., NPDES permits are required for such discharges) as of October 31, 2011.
