Region 9's Programmatic Tribal 401 Cert for Corps' 2012 NWPs

Honorable Leaders and Tribal Environmental Directors,
Attached please find the US EPA's Programmatic Tribal 401 Certification for the US Army Corps of Engineers 2012 Nationwide Permit (NWP) Program. This certification applies to projects that would discharge fill into waters on tribal lands, within USEPA Region 9, that are not already covered under an authorized tribal 401 certification program. We have provided this certification to the Army Corps of Engineers and the states.
Thank you for considering our draft that was previously circulated to you for comments. We believe that the 2012 NWP Program, and this certification, are an improvement since the last round in 2007. If you have any questions or concerns, please do not hesitate to contact me.
