Mary Lauterbach at EPA Hq requests that the Toxics Office in EPA Region IX provide federally-recognized tribes in AZ/CA/NV on a process of consultation/coordination which EPA Hq is now undertaking on proposed rulemaking actions under the federal Toxic Substances Control Act (TSCA) for cadmium, formaldehyde and reassessment on use of polychlorinated biphenyls (PCBs). The U.S. Environmental Protection Agency (EPA) Office of Pollution Prevention and Toxics (OPPT) is initiating consultation and coordination with federally-recognized tribes on these actions: (i) Cadmium Health and Safety Data Reporting under the Toxic Substances Control Act (TSCA) Section 8 (d); (ii) Formaldehyde Standards for Composite Wood Products Rule; and (iii) Reassessment of PCB Use Authorization. This consultation/coordination process is conducted in accordance with EPA Policy on Consultation and Coordination with Indian Tribes
(www.epa.gov/tribal/consultationlconsult-policy.htm).
EPA Hq's OPPT invites your tribe's designated consultation representative(s) to participate in this process. OPPT's anticipated timeline for the consultation/coordination period is expected to extend from December 14,2011- January 31, 2012. During this period, EPA Hq will conduct two National Consultation calls.
