Developing an Environmental Ordinance for the Layperson

Tribal Governments enact rules and regulations to protect their tribal resources including tribal members themselves. Tribal laws usually consider the tribe and its lands as a whole and may include laws over health, education, air, waste, water, fish and animals, elders and children and civil issues. Developing laws is an essential part of tribal governance and sovereignty. Tribes strengthen their sovereignty through asserting and utilizing jurisdictions given to them through federal laws. This workshop is intended for the layperson who is in the field and sees first hand issues to be addressed and resolved through regulatory development. An overview of a variety of existing tribal laws will be provided with special attention to steps taken by tribes to have their tribal laws promulgated through federal action. An anticipated outcome will be an outline for an ordinance. Ordinances should always be developed by working closely with a tribe’s legal office or representative.
